Welcome to Daily Fantasy Market ("DFM", "we", "our", "us"). By creating an account, accessing, or using the DFM website, tools, or services (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. You are responsible for ensuring that your use of the Service complies with the laws of your jurisdiction, including any laws applicable to fantasy sports or online wagering.
2. Accounts & Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
- We may suspend or terminate accounts that we reasonably believe are being used to abuse the Service, violate these Terms, or defraud DFM or other users.
3. Subscriptions & Payments
- Paid plans are billed in advance on a recurring basis through Stripe. By subscribing, you authorize DFM and Stripe to charge your chosen payment method at the interval displayed at checkout.
- Subscriptions automatically renew until cancelled. You may cancel at any time from the Stripe Billing Portal (linked in your dashboard). Cancellation takes effect at the end of the current billing period; you retain access until then.
- Founding Member MVP Pass is limited in number and locks the pass holder's annual price for the life of the account, subject to continuous renewal. Missed renewals may forfeit the founding price.
- Prices, plan features, and included sports may change with notice.
4. Refunds
Subscription fees are generally non-refundable. Refunds may be granted at our discretion for duplicate charges, extended service outages, or when required by law. Email support@dailyfantasymarket.com to open a refund inquiry.
5. Acceptable Use
You agree not to:
- Scrape, copy, resell, or redistribute DFM data, projections, or analytics without written permission.
- Reverse-engineer or attempt to access non-public portions of the Service.
- Use the Service to build a competing product.
- Upload malicious content, spam, or content that infringes on any third party's rights.
- Impersonate another person or misrepresent your affiliation with any entity.
6. User-Provided Data (ESPN Cookies, Lineups, Favorites)
You may provide DFM with information such as ESPN session cookies (SWID, espn_s2) or DFS lineups. You represent that you have the right to share this information and grant DFM a limited license to use it to operate the Service on your behalf. See our Privacy Policy for details.
7. Third-Party Content & Trademarks
The Service references third-party leagues, teams, players, brands, and data providers for identification, informational, and analytical purposes only. All such trademarks and logos are the property of their respective owners. See our Disclaimer for the full attribution notice.
8. Intellectual Property
The Service — including the DFM name, logos, tools, models, projections, grades, code, and content authored by DFM — is protected by copyright, trademark, and other laws and is the exclusive property of Daily Fantasy Market. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial fantasy-sports research.
9. No Wagering Advice
DFM provides research tools and analytics. Nothing on the Service constitutes financial, wagering, or legal advice. You are solely responsible for any decisions you make using the Service, including DFS entries, sportsbook activity, or season-long roster management.
10. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DFM'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID DFM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold DFM and its officers, directors, employees, and agents harmless from any claim, demand, or damages arising out of your breach of these Terms or your misuse of the Service.
12. Termination
You may cancel your subscription and delete your account at any time. We may suspend or terminate your account for violations of these Terms, for suspected fraudulent activity, or if we discontinue the Service. Provisions that by their nature should survive termination (payment obligations, IP, disclaimers, limitation of liability) will survive.
13. Changes to the Terms
We may revise these Terms from time to time. Material changes will be announced in the app or via email. Continued use after a revision constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States and the state where DFM is headquartered, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in that jurisdiction.
